Terms of Service

1. Scope and Provider

These Terms of Service ("Terms") govern the use of email hosting services provided by StackOverJobs GmbH, Mainzer Landstraße 27, 60329 Frankfurt am Main, Germany ("Provider", "we", "us").

By creating an account or using our services, you ("Customer", "you") agree to these Terms.

2. Services

We provide managed email hosting services including: mailbox provisioning, SMTP/IMAP/POP3 access, webmail interface, spam filtering, and related technical infrastructure. Service specifications and features depend on the selected plan.

3. Account Registration

You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old or have the authority to bind your organisation.

Violation of this acceptable use policy may result in immediate account suspension or termination. See our Anti-Spam Policy for details.

5. Service Level Agreement

We guarantee 99.9% uptime for email delivery infrastructure, measured monthly. Scheduled maintenance windows (announced 48 hours in advance) are excluded from SLA calculations. Service credits are available upon request for qualifying outages.

6. Payment and Billing

Fees are billed monthly or annually in advance. All prices are in Euros and exclusive of VAT where applicable. Payment is due upon invoice. We reserve the right to suspend services for accounts with overdue payments exceeding 14 days.

7. Data Processing

We process personal data in accordance with our Privacy Policy and applicable data protection laws (GDPR). A Data Processing Agreement (DPA) is available upon request for business customers.

8. Intellectual Property

All intellectual property rights in our services, website, and documentation remain with StackOverJobs GmbH. You retain all rights to your email content and data.

9. Limitation of Liability

To the maximum extent permitted by law:

This limitation does not apply to damages caused by wilful misconduct or gross negligence, or where mandatory law provides otherwise.

10. Term and Termination

Monthly plans may be cancelled with 30 days' notice. Annual plans may be cancelled at the end of the billing period with 30 days' notice. We may terminate accounts that violate these Terms or our Acceptable Use Policy with immediate effect.

Upon termination, your data will be available for export for 30 days, after which it will be permanently deleted.

11. Modifications

We may modify these Terms with 30 days' advance notice via email. Continued use of our services after the effective date constitutes acceptance. If you disagree with changes, you may terminate your account.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction is Frankfurt am Main, Germany, provided the Customer is a merchant, a legal entity under public law, or a special fund under public law.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
